Copyright and You
While browsing www.simontodd.info you will more then likely see a number of images on the site, (in fact this page is built around a base image)
It is important to note that the use of any images found on this website are subject, without exception, to terms of usage licences.
All images on this site, with the exception of those listed at the bottom of this page and those marked with Creative Commons licences are Copyright, All Rights Reserved to Simon Todd.
What does this mean?
This means that if you wish to use images found on this site (minus the relevant exceptions as outlined) you must apply for a licence to use the images. This will normally incur a charge to yourself based on the type of usage that you require.
Paying for the licence grants you the ability to use the image without watermarks and in a size you choose for a period you choose. Upon the expiration of this licence if you wish to continue to use the image then a new licence will have to be purchased.
But if the photos are taken for my use don’t I own the copyright?
No. Unless copyright is purchased outright or it is prior agreed, copyright is not transferred from the original author of the photographs. This means that it is down to the copyright holder to decide what uses they are willing to allow their work to be used for. Usually these uses will be arranged with a client beforehand and the relevant fees will be paid.
But my images can’t be used elsewhere right?
Wrong, unless an exclusivity period is purchased (or the copyright) the images produced by Simon Todd can be used as and when he sees fit as long as it is not done so in a libellous manner.
When an exclusivity period is purchased Simon Todd is unable to use, or allow the use, of the images covered by the exclusivity period. However, upon expiration of the exclusivity period the use and sale of of images created by Simon Todd are done so at his discretion without having to prior consult the client.
A client may express their wishes for their photo’s to be retained without public licensing however this shall be at the discretion of Simon Todd if no Exclusivity Period has been purchased.
